These terms govern your use of the Nearby app for Shopify. By installing Nearby, you accept them.
Who you are agreeing with
Nearby is provided by Harbour Labs Digital Ltd (“Harbour Labs”, “we”, “us”), registered in England & Wales under company number 17200663. Questions: nearby@harbourlabs.app.
What Nearby does
Nearby is a Shopify app that adds an in-stock store locator to your product pages. It runs as an embedded admin app plus a Theme App Extension on your storefront, and reads your products, inventory, locations, and orders to show shoppers which of your locations has an item in stock.
Your Shopify account
You need an active Shopify store to use Nearby. We rely on Shopify's authentication and billing systems. Anything your Shopify Merchant Agreement covers (account, store ownership, content moderation) sits with Shopify, not with us.
Plans and billing
Nearby offers Free, Starter, and Growth plans. Billing is handled entirely by Shopify via the App Store managed-pricing flow. You can change or cancel your plan from inside the Shopify admin at any time.
- Free includes the compact in-stock widget, real-time inventory, and directions for up to 3 locations.
- Starteradds the full map, theming, “open now” hours, and a contact CTA, for up to 25 locations.
- Growth adds pickup and buy-online, drive-time routes, Google Maps, custom styles, reserve, back-in-stock alerts, and ROI analytics, for unlimited locations.
Pricing is billed in your local currency by Shopify and documented on the Shopify App Store listing and on our website. We reserve the right to change pricing with at least 30 days' notice via in-app notification. If you cancel, you keep access to paid features for the remainder of your billing period.
Your data, your responsibility
Your store's data remains yours. Nearby acts as a data processor on your behalf for it; our handling is described in the privacy policy.
You are responsible for:
- Configuring Nearby and your store locations accurately
- Keeping your location details, opening hours, and pickup information up to date
- Honouring the availability and pickup promises shown to shoppers by the widget
Acceptable use
You must not:
- Use Nearby to display data you have no lawful basis to process
- Reverse engineer or attempt to extract the source code beyond what the licence permits
- Resell or sublicense Nearby
- Use Nearby to facilitate unlawful activity
We may suspend or terminate your access if we have reasonable grounds to believe you have breached this section.
Intellectual property
Nearby (the code, the design, and the brand) is owned by Harbour Labs and licensed to you for use on your Shopify store while you remain a customer. The licence ends when you uninstall the app.
Disclaimer of warranties
Nearby is provided “as is”. Stock availability and distances are derived from the data in your Shopify store and third-party mapping services, and may not always be exact. We make no warranty that the service will be uninterrupted or error-free, and you should treat the widget as a strong indicator rather than a guarantee of availability.
To the maximum extent permitted by law, we exclude all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to Nearby is limited to the amount you paid us in the 12 months preceding the claim. For Free users, that amount is zero.
We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.
Nothing in these terms excludes liability that cannot be excluded by law (for example, liability for fraud, gross negligence, or death and personal injury caused by negligence).
Termination
You can stop using Nearby at any time by uninstalling it from your Shopify admin. Uninstalling cancels any active subscription and triggers data deletion per the privacy policy.
We may terminate your access if you breach these terms, or if we discontinue Nearby (in which case we will give at least 60 days' notice via in-app notification).
Changes to these terms
We may update these terms from time to time. Material changes will be notified via in-app notification at least 30 days in advance. Continued use after the change takes effect means you accept the revised terms.
Governing law
These terms are governed by the laws of England & Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England & Wales.
